Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "User", "you") and Blucindustry Global Supply Limited ("Blucindustry", "we", "us", or "our"), regarding your use of our digital ordering platform, mobile applications, website, and concrete block supply services across Nigeria.

Blucindustry operates a digital-first construction material supply ecosystem that connects customers directly with standardized, vibrated concrete block production facilities, automated scheduling, and monitored haulage logistics.

By accessing Blucindustry, creating an account, or placing an order, you agree to be bound by these Terms of Service and all applicable laws of the Federal Republic of Nigeria. If you do not agree with any part of these Terms, you must immediately discontinue use of our platform and refrain from placing orders through our services.

When using our website, mobile application, or communicating with our team and delivery personnel, you agree to adhere to the following community and operational standards:

• Lawful Use Only: You agree not to use the platform for any illegal purpose or in violation of local, state, or federal laws of Nigeria.

• Accurate Information: All personal, payment, contact, and delivery site details submitted must be true, current, and verifiable.

• System Integrity: You may not attempt to reverse engineer, scrape, introduce malicious code, exploit vulnerabilities, or disrupt our ordering and tracking infrastructure.

• Respectful Engagement: Abusive, threatening, or harassing behavior directed towards our customer support staff, logistics partners, truck drivers, or production agents will result in immediate service termination.

• No Commercial Resale Without Authorization: Unless formally onboarded into the Blucindustry Agent Network, you may not misrepresent yourself as an authorized distributor or affiliate.

To place orders, track live dispatches, and access invoice histories, you may be required to register a customer account:

Account Confidentiality: You are solely responsible for maintaining the confidentiality of your account credentials, passwords, and verification OTPs.

Unauthorized Access: You must notify Blucindustry immediately at security@blucindustry.com if you suspect any unauthorized access or compromise of your account.

Profile Accuracy: You are required to maintain accurate phone numbers and delivery contact personnel. Blucindustry shall not be liable for delayed shipments caused by outdated or unmonitored contact information.

Single Identity: Users may not create duplicate or fraudulent accounts to circumvent promotional restrictions, payment terms, or platform suspensions.

Our supply process is engineered to ensure structural integrity and predictable delivery timelines:

Product Specifications: All blocks supplied are solid or hollow vibrated concrete blocks manufactured in compliance with Standards Organisation of Nigeria (SON) benchmarks and our internal compression quality guidelines.

Order Placement & Confirmation: An order constitutes an offer to purchase. An order is deemed accepted only when payment is verified and a unique Order ID with production schedule is issued.

Minimum Order Quantities: Minimum order quantities (MOQ) apply based on truckload capacities (e.g., standard tipper loads of 500 or 1,000 units depending on block inch dimensions).

Price Quotations: Prices displayed include unit production and estimated haulage to the specified delivery zone. Prices remain subject to periodic revision due to cement, aggregate, or fuel market fluctuations prior to payment confirmation.

To ensure seamless logistics and material readiness, all orders require full settlement before trucks leave the production yard:

Payment Methods: We accept secure electronic card transactions (Mastercard, Visa, Verve), direct bank transfers, and USSD via our authorized payment processor, Paystack.

Security & Storage: All card details and banking credentials are encrypted and processed by Paystack under PCI-DSS Level 1 compliance. Blucindustry never stores your payment card credentials.

Payment Verification: For manual bank transfers, production and dispatch scheduling commence only after our finance desk confirms receipt of funds in our corporate account.

Taxes & Receipts: Invoices clearly reflect all applicable Value Added Taxes (VAT) and haulage charges. Electronic receipts are delivered to your registered email upon successful transaction completion.

Because vibrated concrete blocks are heavy, cured structural materials requiring dedicated logistics:

Cancellation Window: You may cancel an order free of penalty within two (2) hours of payment, provided loading has not commenced.

After Loading / In Transit: Once trucks are loaded or departed from the yard, orders cannot be cancelled, redirected, or refunded, as transport and labor costs have already been incurred.

Refund Processing: Approved refunds are credited back to the original source payment method within five (5) to seven (7) business days, less any administrative or payment gateway transaction charges where applicable.

Defective Products: In the rare event of verified structural defects reported within the inspection period, replacement blocks or prorated refunds will be issued per Section 12.

Our haulage partners strive to deliver orders according to estimated schedules:

Site Accessibility: The customer guarantees that the delivery destination is accessible by heavy-duty haulage vehicles (6-tire to 10-tire tippers). If a truck cannot reach the designated spot due to low-hanging cables, mud, narrow gates, or unpaved terrain, offloading will occur at the nearest safe point.

Offloading Demurrage: Standard delivery includes an offloading window of up to two (2) hours from arrival. If our driver is detained on site beyond this window due to customer unavailability or lack of offloading labor, a demurrage fee of ₦10,000 per additional hour may be assessed.

Nominal Transit Breakage: In line with construction industry standards in Nigeria, a nominal breakage allowance of up to two percent (2%) may occur during rough road transit. Breakage exceeding this threshold must be documented on the delivery note prior to driver departure.

To facilitate smooth fulfillment, customers agree to fulfill the following obligations:

Authorized Receiver on Site: You or an authorized site engineer/representative must be present at the delivery location to verify physical quantities and inspect product condition.

Community & Local Levies: Customers are solely responsible for managing and paying any local youth levies, community settlement fees, or "matching ground" charges required by residents or associations in the delivery area. Delivery drivers will not bear or negotiate community fees.

24-Hour Inspection Window: You must inspect all blocks upon delivery and report any discrepancy, shortage, or structural failure in writing within twenty-four (24) hours of offloading via legal@blucindustry.com or our Report Abuse form.

Individuals and manufacturing yards admitted into the Blucindustry Agent Network operate under rigorous contractual obligations:

Quality & Mix Ratios: Agents must strictly adhere to Blucindustry standard operating mix formulations, clean washed sharp sand, potable water, and mandatory minimum 7-day curing schedules.

Prompt Dispatch Notification: Agents must immediately update production milestones, batch availability, and truck departures through the Blucindustry Agent Portal.

Zero Off-Platform Redirection: Agents are strictly prohibited from soliciting Blucindustry customers to transact outside the platform. Doing so constitutes immediate forfeiture of commissions, termination of certification, and potential legal recovery.

In the event of any controversy, claim, or disagreement arising from your transaction or use of our platform:

Informal Negotiation: The parties agree to attempt in good faith to resolve any dispute through direct informal negotiation for a period of not less than fourteen (14) business days.

Mediation & Arbitration: If the dispute is not resolved informally, it shall be submitted to binding arbitration under the Arbitration and Mediation Act of Nigeria, conducted in English in Imo State or Lagos State, Nigeria.

Governing Law & Jurisdiction: These Terms are governed by, and construed in accordance with, the laws of the Federal Republic of Nigeria. Both parties consent to the exclusive jurisdiction of Nigerian courts.

Blucindustry maintains full discretion to enforce platform integrity:

Grounds for Immediate Suspension: We may immediately suspend or permanently deactivate your account or cancel pending orders if we detect fraudulent transactions, chargeback abuse, harassment of drivers, or false defect claims.

Customer Termination: You may terminate your account at any time by clearing all pending financial obligations and contacting privacy@blucindustry.com.

Survival of Terms: Provisions relating to intellectual property, warranty disclaimers, dispute resolution, and limitations of liability shall survive any termination of this agreement.

Please read this section carefully, as it outlines the extent of our legal liability:

7-Day Quality Replacement Guarantee: Blucindustry warrants that all vibrated concrete blocks delivered will be structurally sound and free from defective mixing. We will replace or refund defective blocks reported within seven (7) days of delivery, provided they have not been compromised by improper on-site storage, waterlogging, or premature structural loading.

Exclusion of Consequential Losses: To the fullest extent permitted by Nigerian law, Blucindustry shall not be liable for indirect, incidental, special, or consequential damages, including loss of profits, site construction delays, labor downtime, or structural contractor failures.

Monetary Liability Cap: In no event shall Blucindustry's total aggregate liability arising out of or related to an order exceed the total purchase price actually paid by the customer for that specific order.
